Drone Operations & Aerial Photography Policy
Last Updated: April 24, 2026
Our Commitment to Safe & Responsible Drone Operations
Quincy Aerial, LLC is a professional aerial photography and media company based in Michigan’s Upper Peninsula. We provide commercial drone photography, videography, and related imaging services throughout the Keweenaw Peninsula and surrounding regions.
All commercial drone operations are conducted under applicable Federal Aviation Administration (FAA) regulations, including 14 CFR Part 107, which governs the commercial use of small unmanned aircraft systems (UAS) in the United States.
Quincy Aerial is operated by an FAA-certified Remote Pilot in Command, Certificate No. #4296209.
We are committed to conducting every flight safely, legally, and professionally while respecting private property, public lands, wildlife, natural resources, and the communities we serve.
Federal Aviation Regulations & Airspace
The Federal Aviation Administration (FAA) regulates the safety and use of navigable airspace throughout the United States, including airspace above public lands, privately owned property, conservation areas, and other managed landscapes.
Under applicable federal regulations, properly authorized drone operators may conduct flights in permitted airspace, provided they comply with relevant operational requirements and restrictions.
Ownership of the land beneath an aircraft does not, by itself, establish exclusive control over the airspace above that property.
Drone operations may therefore be permissible above privately owned or publicly managed property without obtaining permission from the underlying landowner solely for the overflight. However, applicable aviation regulations, privacy laws, property rights, and other legal restrictions must still be observed.
Quincy Aerial evaluates flight operations based on applicable FAA regulations, airspace classifications, temporary flight restrictions, operational safety requirements, and other relevant laws.
Our operations may include aerial photography of residential and commercial properties, public landscapes, forests, waterways, natural features, and other locations where drone operations are legally permitted.
Michigan Drone Laws & State Regulations
In addition to federal aviation regulations, Quincy Aerial operates in accordance with Michigan’s Unmanned Aircraft Systems Act (Public Act 436 of 2016), which establishes the legal framework for drone operations throughout the state.
Under Michigan Compiled Laws (MCL) 259.311, FAA-authorized commercial drone operators are permitted to conduct operations within Michigan in accordance with federal regulations.
Michigan law also recognizes the authority of the FAA over navigable airspace while establishing protections for privacy, property rights, and public safety.
Quincy Aerial is committed to complying with all applicable federal and state regulations while conducting safe, responsible, and professional aerial photography operations throughout Michigan’s Upper Peninsula.
Property Access, Takeoffs & Landings
Quincy Aerial recognizes the distinction between operating an aircraft in permitted airspace and physically accessing property on the ground.
We respect private property rights and do not knowingly enter private property without appropriate permission or other lawful authorization.
When operating from private property, we obtain permission or authorization as appropriate for ground access, equipment setup, takeoff, and landing.
Public lands, parks, preserves, conservation properties, and other managed areas may have additional rules governing drone launches, landings, commercial activities, and property access.
Quincy Aerial complies with applicable restrictions and obtains required permissions or permits when necessary.
Restrictions on ground access, takeoffs, and landings do not automatically constitute restrictions on otherwise lawful aircraft operations in the airspace above a property. Any applicable airspace restrictions and other legal limitations are evaluated separately.
Flight Safety & Operational Authority
The Remote Pilot in Command maintains final authority and responsibility for determining whether a drone operation can be conducted safely and in compliance with applicable regulations.
Before and during operations, Quincy Aerial considers factors including:
- Airspace restrictions and required authorizations
- Weather conditions, visibility, and wind
- Nearby aircraft and other aviation activity
- People, vehicles, buildings, and surrounding obstacles
- Wildlife and environmentally sensitive areas
- Equipment condition and operational limitations
- Applicable property access and land-management requirements
Quincy Aerial reserves the right to delay, modify, relocate, suspend, or cancel any flight when conditions present an unacceptable safety risk or when an operation cannot be completed in compliance with applicable laws.
No photograph, video, or commercial assignment takes priority over aviation safety.
Photography Over Public & Private Property
Aerial photography may capture land, buildings, landscapes, roads, waterways, and other features visible from legally accessible airspace.
Quincy Aerial conducts such photography in accordance with applicable federal, state, and local laws, including relevant privacy protections.
The presence of privately owned property within an aerial photograph does not automatically mean the photograph was captured unlawfully or that the property owner must authorize its publication.
Quincy Aerial also respects the privacy and safety of neighboring property owners when conducting commissioned photography assignments.
Environmental Responsibility & Wildlife Protection
The natural landscapes of Michigan’s Upper Peninsula are an important part of our work. Quincy Aerial recognizes the importance of protecting forests, wildlife, waterways, conservation lands, and other sensitive environments.
We strive to minimize unnecessary disturbance during aerial photography operations and avoid activities that could create unreasonable risks to wildlife, natural habitats, or visitors.
Flights may be adjusted or discontinued when wildlife activity, environmental conditions, or applicable restrictions make continued operations inappropriate.
We recognize that some areas may be subject to additional protections, including restrictions related to wildlife, protected species, nesting areas, or land-management activities.
Quincy Aerial complies with applicable environmental and wildlife protection laws and respects the conservation efforts of organizations, landowners, and public agencies throughout the region.
GPS Coordinates, Flight Records & Location Information
Quincy Aerial maintains a policy of limiting the voluntary public disclosure of detailed location and operational information associated with its aerial photography.
As a general business practice, we do not publicly provide or disclose:
- Precise GPS coordinates associated with individual photographs or videos
- Drone takeoff and landing locations
- Detailed flight paths, telemetry, or operational logs
- Exact locations of sensitive natural features or wildlife habitats
- Nonpublic client property information
- Other proprietary operational details
This policy helps protect client privacy, sensitive locations, natural resources, and confidential business information.
Photographs and videos may be identified by a general geographic area, community, landmark, or region without disclosing the exact position from which they were captured.
This disclosure policy is an internal business practice and is not an FAA requirement to withhold GPS coordinates.
Exceptions and Regulatory Compliance
Quincy Aerial complies with applicable FAA recordkeeping, inspection, and Remote ID requirements. Remote ID-equipped aircraft may broadcast identifying and location-related information during flight as required by federal regulations.
Operational records or location information may be provided when required by applicable law, lawful legal process, FAA regulations, or authorized government investigations. Information may also be disclosed when necessary for legitimate safety purposes or when otherwise authorized by Quincy Aerial.
This policy does not prevent disclosures required by law or restrict information independently available through legally required aircraft identification systems.
Ownership, Copyright & Media Licensing
Unless otherwise agreed to in writing, photographs, videos, and other creative media produced by Quincy Aerial remain the intellectual property of Quincy Aerial, LLC and are protected under applicable copyright laws.
Commissioned photography services generally include a license to use the delivered media for the purposes specified in the applicable service agreement.
For real estate photography, standard licensing is generally limited to marketing the property associated with the original assignment during the applicable listing or marketing period, unless additional usage rights are granted.
Commercial publication, redistribution, resale, transfer, or use by third parties may require separate licensing or written authorization.
Quincy Aerial may also independently capture aerial photography for editorial, documentary, artistic, commercial, or other lawful purposes.
Such photography may be licensed to news organizations, publishers, businesses, nonprofits, and other parties, subject to applicable laws and licensing arrangements.
Publication of an aerial photograph does not, by itself, establish a right for third parties to obtain the original media, precise capture coordinates, or associated flight records.
Any licensing or publication arrangement is separate from the legal requirements governing the original flight operation.
Client Confidentiality & Privacy
Quincy Aerial respects the confidentiality of client projects and information obtained through professional assignments.
Nonpublic information concerning client properties, project details, access arrangements, or other confidential matters is not intentionally disclosed to unrelated third parties without authorization, except where required by law or otherwise permitted under an applicable agreement.
We may use selected photographs and videos for our portfolio, website, social media, promotional materials, and other business purposes, consistent with applicable client agreements and licensing restrictions.
We take reasonable steps to avoid disclosing sensitive information through publicly shared media and associated metadata.
Questions, Concerns & Requests for Information
Quincy Aerial welcomes respectful communication regarding its drone operations and aerial photography.
Individuals, property owners, land-management organizations, and public agencies with questions or concerns are encouraged to contact us directly.
We are willing to review specific concerns involving aviation safety, property access, privacy, environmental protection, or potential violations of applicable regulations.
However, requests for detailed flight records, precise GPS coordinates, proprietary operational information, or confidential client information will be evaluated individually and are not automatically granted.
Quincy Aerial reserves the right to decline voluntary requests for nonpublic information when disclosure is not legally required or otherwise appropriate.
Where a concern involves a specific flight, we may request relevant details to evaluate the matter accurately.
Applicable Laws & Policy Updates
Quincy Aerial conducts its operations in accordance with applicable federal, state, and local laws.
This policy describes our general operating practices and does not supersede FAA regulations, applicable laws, land-use requirements, contractual obligations, or lawful government authority.
Nothing in this policy is intended to authorize operations that are otherwise prohibited by law, limit legally protected rights, or prevent disclosures required by lawful process.
Quincy Aerial reserves the right to revise this policy as regulations, operational practices, or business needs change.
